WebInsure acts as a public liability insurance broker for Australian businesses, helping arrange cover for third-party injury and third-party property damage claims arising from your business activities.

Public liability insurance is commonly required under contracts, leases and site access conditions. A broker helps ensure the policy matches your operations and the way you actually work — not just a generic online description.

Speak with a broker about your business activities and suitable public liability options.

What is public liability insurance?

Public liability insurance is designed to protect a business against legal liability for third-party injury or third-party property damage that occurs in connection with the business. Policies differ in definitions, exclusions and conditions, so advice-led placement matters.

Who typically needs public liability cover?

Public liability insurance is common across many industries, particularly where there is interaction with the public, work performed at third-party premises, or contractual insurance requirements.

It is often relevant for:

  • Trades and contractors
  • Service businesses visiting client sites
  • Retail and hospitality
  • Manufacturers and suppliers (products exposure)
  • Property owners and landlords (in certain arrangements)

Public liability vs products liability

Many policies combine public liability and products liability. Products liability relates to claims arising from goods you supply or sell. Whether products exposure applies depends on your business activities and how your operations are described to insurers.

Key details that affect cover

Public liability policies are not identical. A broker helps you consider:

  • Business description – accuracy is critical for claims
  • Limit of indemnity – contracts often specify a minimum limit
  • Territory and jurisdiction – where the policy responds
  • Subcontractor arrangements – and how they are treated
  • Exclusions – for example, certain high-risk activities or work types
  • Contractual requirements – including principal indemnity clauses

Common scenarios where brokers add value

  • Contractor work with changing scopes and job types
  • Businesses operating across multiple sites or states
  • Higher-risk activities requiring specialist underwriting
  • Businesses that need certificates of currency quickly and correctly

Public Liability Insurance — What It Covers

Public liability insurance covers your legal liability to third parties for personal injury or property damage arising from your business activities. If a customer is injured at your premises, a contractor damages a client’s property, or a product you supply causes injury or damage, public liability insurance responds to the legal costs and compensation claims that result.

Products liability — covering claims arising from products you manufacture, supply or distribute — is typically combined with public liability in a single policy. The combined limit applies to both public and products liability claims.

Choosing the Right Limit

Public liability policies are available with limits ranging from $5 million to $20 million or more. The right limit depends on the nature of your business, the scale of your operations, and any contractual requirements. Government contracts, resource company contracts and major construction contracts typically require minimum limits of $10 million to $20 million. Small retail and service businesses may be adequately covered at $5 million to $10 million.

WebInsure reviews the contractual insurance requirements applicable to your business and recommends a liability limit that meets both legal requirements and reflects the actual risk profile of your operations.

Exclusions to Be Aware Of

Standard public liability policies exclude professional advice and design liability (covered by professional indemnity), product recall costs, intentional acts, pollution (except sudden and accidental), and in some cases, contractual liability assumed by agreement. Understanding these exclusions before a claim is more useful than discovering them afterwards.
